What is premises liability?
Premises liability cases involve suffering injuries while on someone else's property. Businesses and property owners have duties to maintain safe properties for customers, pedestrians, and other visitors and to effectively warn people of possible dangers such as water on a waiting room floor or a spill in a supermarket.
Proving negligence in a Mississippi or Tennessee premises liability case can be difficult because a property owner is not responsible simply because someone was injured on his or her property. If the property owner is proven to be negligent, he or she must pay for losses caused by the dangerous condition of the property. The injured person must first prove:
- The condition of the property was dangerous.
- The owner knew, or should have known, about the unsafe condition.
- The owner had a reasonable timeframe to correct or warn of the condition, which was not reasonably open and obvious to the injured party at the time of the accident.
What are examples of premises liability?
- Inadequate security (i.e. lights, surveillance) resulting in a preventable assault by a third party
- Trip-and-falls caused by damaged or uneven walkways, slippery stairs, or poor upkeep
- Construction site injuries, particularly those involving persons other than workers
- Slip and falls caused by slippery floors or standing water, ice, or snow
- Products falling off of shelves at a store
- Pool drownings
What kind of compensation can I expect for my injuries?
If you are injured in a slip and fall accident because a Tennessee or Mississippi property owner or a business establishment failed to provide a safe environment, you have a right to bring a claim for your pain and suffering, medical expenses, and lost wages.
