Large Personal Injury Cases:

John Michael Bailey was able to obtain the Statutory Maximum allowable for a client who was injured when a bus stopped to pick her up, but pulled away from the curb before she was able to board the bus. The client was thrown backwards by the bus, and subsequently fell against the curb and broke her hip. The settlement Mr. Bailey was able to negotiate was $350,000.

Mr. Bailey was able to obtain a settlement of $750,000 for a client who was rear ended by a teenage driver. The client was a young mother traveling with her three children in the car when the accident occurred. The impact threw the client from the car where she landed on the hot asphalt subsequently burning her skin severely. This settlement helped the client get the treatment she deserved and money for the pain and suffering that she and her children endured.

Workers' Compensation:

A client who worked as an auto mechanic removing transmissions became disabled when the repetitive gripping and pulling required by his job caused him to develop Carpal Tunnel Syndrome in both wrists. He required two surgeries on one of his wrists, but it was not successful. He then developed cysts on his hands, and even more sadly, he was diagnosed with Lupus which continued to become worse during his treatment for Carpal Tunnel Syndrome. This client received a lump sum Worker's Compensation settlement of $64,000. Cases cannot solve themselves and this is why we go the extra mile.

A client who was a lifelong truck driver suffered a ruptured disk in his back while on the job. This injury resulted in permanent nerve damage and numbness. This case is still pending, however, our office does more than obtain compensation for our clients. Social Security Disability Department Supervisor, Benita Anderson Williams, has worked with this client's auto finance company to receive a 90 day extension on car payments, and to prevent foreclosure on this client's home while we work on getting a settlement. When someone is hurt on the job and unable to work, they need an attorney who is on their side from the beginning of the case until the end.

Another interesting Worker's Compensation Case involved a man who injured his back so badly at work that he required surgery to correct his lumbar strain and ruptured disk. Screws, bolts and steel rods are now permanently in place in his back. He is permanently injured, unable to lift, bend or stoop. Our office was able to obtain a Worker's Compensation settlement for this gentleman in the amount of $61,811.

Social Security Disability Cases:

Many Workers' Compensation cases go on to become Social Security Disability cases because the client is disabled after the injury. The above case regarding the auto mechanic resulted in not only the initial $64,000 settlement, but a Social Security Disability lump sum payment of approximately $34,000 for the client, and $9,000 and $6,000, respectively for his two minor children. He will also receive a monthly Social Security Disability check for $1,472 for the client and his two minor children will receive $530 per month in Social Security Disability until they reach the age of 18 years.

The above case that involved a client who needed screws, bolts and metal rods placed in his back also became a Social Security Disability case. In addition to the more than $61,000 Workers' Compensation settlement, this client also received a Social Security lump sum of $6,612.75 and is now receiving a monthly check in the amount of $738.

Automobile Accident Litigation Cases:

Cindy Garcia, and Paralegal, Laura Branch, work diligently in their department in order to get the clients what they deserve for their injuries. If a settlement cannot be reached and the case goes to trial before a jury, these two knowledgeable team players really get the job done. As the head of the department, Mrs. Garcia does whatever it takes to get the case to trial quickly, and to get to court prepared. This includes locating witnesses, investigation and intricate research. This department has several ongoing cases that are still pending.

One case started with law enforcement involved in a car chase with a suspect. Unfortunately, our client's vehicle was struck by the suspect's vehicle causing her to be hospitalized for 15 days. Her injuries included a severely hurt back, multiple deep cuts, and broken bones. When this case goes to trial, Mrs. Branch and Mrs. Garcia expect the settlement to exceed $110,000.

Another case involves a nurse who was on her way into the hospital where she worked, and was struck by a car as she crossed the street using the pedestrian crosswalk. When this case goes before a jury, a settlement in excess of $150,000 is expected.

Mass Tort (Class Action Cases):

Our office handles Mass Tort cases on a regular basis, with emphasis placed on those clients whose injuries have been quite severe. One example is the Mass Tort case involving “Baycol”, which is a cholesterol lowering drug. It has now been determined that this particular medication causes muscle cell damage, and in the most severe cases can lead to kidney failure. We recently received a settlement for a client of approximately $510,000.00. We also have cases pending regarding “Phen-Phen”, a weight loss drug, “Vioxx”, an arthritis drug and “HRT”, hormone replacement therapy.
